New York Attorney General Eric Schneiderman and Gov. Andrew Cuomo said Monday the state will sue President Trump if he ends the Deferred Action for Childhood Arrivals program.
"President Trump's decision to end the DACA program would be cruel, gratuitous, and devastating to tens of thousands of New Yorkers — and I will sue to protect them," Eric Schneiderman said in a statement.
Trump on Tuesday is expected to declare he will end DACA, a program former President Barack Obama created unilaterally that protects certain immigrants who were brought illegally to the U.S. as children and gives them work permits.
The president is expected to delay the termination of DACA for six months, according to multiple reports, to give Congress time to devise a legislative solution to protect the 800,000 or so illegal immigrants who benefit from the program.
Schneiderman and Cuomo, both Democrats, said more than 40,000 New Yorkers are protected under DACA.
The duo claims these beneficiaries pay more than $140 million in state and local taxes.
They did not say what the basis of the lawsuit would be, although Cuomo said pursuing legal action would protect New York's "sovereign interest."
"If he [Trump] moves forward with this cruel action, New York State will sue to protect the ‘dreamers' and the state's sovereign interest in the fair and equal application of the law," Cuomo said.
