Phoenix Mom Sentenced For Not Reporting Child Abuse In Girl's Death

An Ahwatukee woman was sentenced to two years probation Wednesday in connection with the beating death of her 3-year-old daughter in 2011.

Ambreatte Smith, 29, pleaded guilty to child abuse in 2012. Authorities said she knew her then-husband was abusing her daughter, Dani Mayo, but failed to report it.

The abuse ultimately led to Dani's death. Corey Daniels entered a guilty plea last month for first-degree murder and child abuse. His sentencing is set for Nov. 17 in Maricopa County Superior Court.

On Wednesday, Judge Warren Granville sentenced Smith to two years probation, less than the presumptive 10 years, because she has been "very compliant" during her previous probationary period. Smith has been out of custody and awaiting sentencing for a little over five years.

Defense attorney Robyn Varcoe said Smith regrets her actions and has the ability to be a productive citizen.

"I have had the opportunity to get to know Ambreatte Smith really well," Varcoe said. "She grieves every second of every day for her daughter."

Smith did not make a statement on her own behalf.

Police said photos and text messages between Smith and Daniels from 2011 show Smith knew Daniels was physically abusing her daughter between early September and late October of that year.

The photos on Smith's phone showed some of the injuries Dani suffered. A text message conversation from October 2011 mentions Daniels leaving bruises and bite marks on the girl, police said.

The fatal beating of Dani occurred on Oct. 27 while Smith was at work, according to court documents. Daniels told police he started beating the girl with his fists after she refused to eat a hot dog. He then switched to a belt and lashed her more than 36 times, records show.

An autopsy report showed Dani suffered multiple blunt-force trauma injuries, brain swelling and extensive bruising.
